A Federal High Court in Abuja has adjourned a suit filed by former Vice-President and African Democratic Congress (ADC) presidential candidate Atiku Abubakar, challenging President Bola Tinubu’s eligibility to contest the 2027 presidential election.
Atiku is asking the court to disqualify Tinubu over an alleged discrepancy in the name appearing on the NYSC discharge certificate submitted to the Independent National Electoral Commission (INEC).
The case was stalled after Atiku’s counsel, Joseph Onu, told the court that he had been unable to personally serve the President with the originating summons.
During the proceedings, counsel representing Tinubu attempted to receive the court documents, but Onu rejected the move, insisting that the President must be served personally or through substituted service.
Atiku filed the suit on Friday, arguing that the NYSC certificate submitted by Tinubu to INEC contains a name that differs from the President’s official name.
According to the plaintiffs, the certificate bears the name “Tinubu Bola Adekunle”, while the President is officially known as “Bola Ahmed Tinubu”.
They want the Federal High Court to determine whether the alleged discrepancy affects Tinubu’s constitutional qualification to contest the 2027 presidential election.
The suit is part of Atiku’s broader challenge to Tinubu’s eligibility as the 2027 election approaches.
After hearing from the parties, Justice Inyang Ekwo adjourned the matter until September 28 for further mention.
The legal battle comes as both Atiku and Tinubu prepare for another potential presidential contest, having faced each other in the 2023 election, which Tinubu won.
Tinubu is seeking another term under the platform of the All Progressives Congress (APC), while Atiku is expected to contest under the ADC.
