0

Imade Osarenkhoe’s strike from six yards on the dot of half time, after handball in the box by Rangers’ defender Chinemerem Ugwueze, handed Bendel Insurance this year’s NFF-TINGO Federation Cup title and a ticket to represent Nigeria in next season’s CAF Confederation Cup competition.

The ‘Flying Antelopes’ threw in all they could muster in an interesting encounter at the Stephen Keshi Stadium, Asaba on Wednesday, but the ‘Benin Arsenal’ were determined to hew something out of a see-saw season in which they remained unbeaten in the Nigeria Premier Football League regular season only to end up empty-handed in the Playoff Championship.

Insurance had come close in the 16th minute when Deputy Echeta hit the ball hard and goalkeeper Detan Ogundare spilled the shot, only for the rebound to be diverted.

A minute into the restart, Rangers’ Shedrack Asiegbu let fly from the left side, but the effort went over the bar. In the 55th minute, Insurance goalkeeper Amos Obasogie spilled a shot from Rangers’ Godwin Obaje but there was no follow-up, and in the 70th minute, Osarenkhoe’s intelligent chip from a free-kick was tipped over the sticks by Ogundare.

In the women’s final played earlier in the afternoon, Cup holders Bayelsa Queens retained the trophy with a 4-3 penalty shoot-out defeat of Rivers Angels after regulation time ended 0-0.

Former junior international goalkeeper Onyinye Okeke saved from Angels’ substitute Sofia Agyaakwa before Zainab Olapade scored to give joy to the Bayelsa fans.

Women’s champions Bayelsa Queens pocketed the sum of 10 million naira (Ten Million Naira Only) while Rivers Angels were five million naira (N5 Million Naira Only) richer.

Men’s winners Bendel Insurance went home with the sum of 15 million naira (Fifteen Million Naira Only) while Rangers International got the sum of Seven Million and Five Hundred Thousand Naira Only.

Rivers Angels’ forward Adaobi Okah won the top scorer award in the women’s category with her five goals, while Lobi Stars’ Joseph Atule and Kwara United’s Kamal Samad tied for the same award in the men’s category with four goals each.

Arsenal have agreed a deal with Chelsea worth around £65m for Germany international forward Kai Havertz.

It is understood the clubs have made an agreement in principle that will allow the player to discuss personal terms and have a medical.

The fee for Havertz, who scored nine goals in 47 games for the blues last season, could rise with add-ons.

Havertz is set to move across London as Mikel Arteta looks to strengthen his arsenal team following qualification for the champions league.

Arsenal are also chasing England midfielder Declan Rice, the west ham captain, but a second bid for the 24-year-old – worth up to £90m – was rejected on Tuesday.

Chelsea, meanwhile, are seeking to reduce their squad size and have also agreed a £30m deal with Manchester city for Croatia midfielder Mateo Kovacic.

Another midfielder, France international N’golo Kante, has agreed to sign for Saudi Arabian champions Al-ittihad when his contract expires at the end of June.

The new ownership at Chelsea want to avoid letting players enter the final two years of their deals and Havertz, whose contract runs out in 2025, has not agreed an extension at the club.

Bendel Insurance ended a 43-year wait for a domestic title on Wednesday after beating Enugu rangers 1-0 to claim the 2023 federation cup title as well as a prize of N15m at the Stephen Keshi stadium, Asaba.

A first-half penalty by Osarenkhoe Imade was all that mattered for the Benin arsenal to claim their fourth federation cup title and also picked the last continental ticket to represent Nigeria in next season’s CAF confederation cup.

As two of the traditional sides in the country, insurance and rangers faced off in the final for the third time in the competition’s history having met in the 1978 and 1981 finals. In their previous two clashes in the final, insurance won the 1978 edition 3-0, while rangers avenged the loss with a 2-0 triumph three years later.

Muhammad Shehu, the RMAFC’s chairman, announced that the salaries of those who occupy public office, including judicial and political positions, would be raised by 114%. According to the News Agency of Nigeria, NAN, Shehu remarked on Tuesday when he gave Kebbi State Governor Nasir Idris the reports on the reviewed compensation package. Civil society organizations, CSOs, law professors, and Senator Shehu Sani, however, were outraged by the development and claimed that ordinary workers, whose take-home pay was not particularly impressive, were the ones who should have received such a wage increase rather than politicians.

Rakiya Tanko-Ayuba, a federal commissioner in the commission, represented the RMAFC Chairman, who said that the examined compensation packages had been implemented successfully. Rakiya Tanko-Ayuba, a federal commissioner in the commission, served as the RMAFC Chairman’s representative. She stated that the evaluated compensation packages would be implemented as of January 1, 2023.

According to him, the action was taken in compliance with the clause in paragraph 32(d) of part 1 of the Third Schedule of the Federal Government’s 1999 Constitution (as amended).
He recommended the state Houses of Assembly to swiftly alter pertinent laws to make room for an upward revision of compensation packages for political, judicial, and public officers.
The “certain political, public and judicial office holders (salaries and allowances, etc) (Amendment) Act, 2008,” he noted, was the result of the most recent review of compensation, which was undertaken in 2007.

Prof. Chidiebere Onyia, the Secretary to the State Government, announced this on Wednesday in Enugu.

Court Fixes Date For Diezani’s Suit Hearing Against EFCC

0

A Federal High Court, Abuja has fixed Oct. 23 to hear a suit filed by former Minister of Petroleum Resources, Diezani Alison-Madueke, challenging the order obtained by the EFCC for final forfeiture of her seized assets.

Justice Inyang Ekwo fixed the date on Wednesday after Alison-Madueke’s lawyer, Benson Igbanoi, and EFCC’s counsel, M.D. Baraya regularised their processes in the suit.

The News Agency of Nigeria (NAN) reports that the anti-corruption agency had planned to conduct a public sale of all the assets seized for being proceeds of crime as ordered by courts to be permanently forfeited to the Federal Government.

The auctioning exercise, conducted on the seized assets believed to include Diezani’s property, started on Jan. 9.

The immediate-past chairman of EFCC, Abdulrasheed Bawa, had recently revealed that $153 million and over 80 property had been recovered from Alison-Madueke.

She was alleged to have escaped to the United Kingdom and remained there after her exit from public office as the petroleum minister, an office she held between 2010 and 2015 under the administration of former President Goodluck Jonathan.

But the ex-minister, in her suit, sought an order extending the time within which to seek leave to apply to the court for an order to set aside the EFCC’s public notice issued to conduct public sale on her property.

In the motion marked: FHC/ABJ/CS/21/2023 dated and filed on Jan. 6 by her lawyer, Chief Mike Ozekhome, SAN, the former minister sought five orders from the court.

While Alison-Madueke is the applicant, the EFCC is the sole respondent in the suit.

The former minister, who argued that the various orders were made without jurisdiction, said these “ought to be set aside ex debito justitiae.”

She said she was not given fair hearing in all the proceedings leading to the orders.

“The various court orders issued in favour of the respondent and upon which the respondent issued the public notice were issued in breach of the applicant’s right to fair hearing as guaranteed by Section 36 (1) of the 1999 Constitution, as altered, and other similar constitutional provisions,” she said.

She argued that she was neither served with the charge sheet and proof of evidence in any of the charges nor any other summons howsoever and whatsoever in respect of the criminal charges pending against her before the court.

She further argued that the courts were misled into making several of the final forfeiture orders against her assets through suppression or non-disclosure of material facts.

“The several applications upon which the courts made the final order of forfeiture against the applicant were obtained upon gross misstatements, misrepresentations, non-disclosure, concealment and suppression of material facts and this honourable court has the power to set aside same ex debito justitiae, as a void order is as good as if it was never made at all.

“The orders were made without recourse to the constitutional right to fair hearing and right to property accorded the applicant by the constitution.

“The applicant was never served with the processes of court in all the proceedings that led to the order of final forfeiture,” she said, among other grounds given.

But the EFCC, in a counter affidavit deposed to by Rufai Zaki, a detective with the commission, urged the court to dismiss her application.

Zaki, who was a member of the team that investigated a case of criminal conspiracy, official corruption and money laundering against the ex-minister and some other persons involved in the case, said investigation had clearly shown that she was involved in some acts of criminality.

He said Alison-Madueke was therefore charged before the court in charge no: FHC/ABJ/CR/208/2018.

“We hereby rely on the charge FHC/ABJ/CR/208/2018 dated 14th November 2018 filed before this honourable court and also attached as Exhibit C in the applicant’s affidavit,” he said.

The EFCC operative, who said he had seen the ex-minister’s motion, said most of the depositions were untrue.

He said contrary to her deposition in the affidavit in support, most of the cases which led to the final forfeiture of the contested property “were action in rem, same were heard at various times and determined by this honourable court.”

He said the courts differently ordered the commission to do a newspaper publication inviting parties to show cause why the said property should not be forfeited to the Federal Government before final orders were made.

Zaki argued that one Nnamdi Awa Kalu represented the ex-minister in reaction to one of the forfeiture applications.

“We humbly rely on the judgment of Hon. Justice I.LN. Oweibo dated 10th September 2019 shown in Exhibit C of the applicant’s affidavit,” he said.

The officer said contrary to her, the final forfeiture of the assets which were subject of the present application was ordered by the court in 2017 and that this was not set aside or upturned on appeal.

According to him, the properties have been disposed of through due process of law.

Naira Gains 0.87% Driven by Willing Buyers, Sellers

Naira on Wednesday gained 0.87 percent against the dollar at the Investors and Exporters (I&E) forex window, Nigeria’s official market.

After trading on Wednesday, the dollar was quoted at N763.17 as against N756.61 quoted on Tuesday at the I&E window.

The naira appreciation was attributed to the activities of the willing buyers and willing sellers in the market as the market recorded high bids at the rate of N815 per dollar.

At the parallel market, naira depreciated by 1.17 percent as the dollar traded at N765 on Wednesday compared to N756 on the previous day.

Traders attributed the naira depreciation at the black market to increased demand for dollars from individuals for school fees and travel allowances.

On June 14, 2023, the Central Bank of Nigeria (CBN) collapsed all segments in the FX market into the investors’ and exporters window.

This means that all eligible FX transactions in the market shall only be done via the I&E window, all other windows cease to exist.

The I&E market functions by a willing buyer, willing seller system, where an entity with demand for FX seeks out another entity with FX to sell at an agreed price through an authorised dealer.

Oil Regulator Set to Release More Rules to Guide Operations

The Nigeria Midstream Downstream Petroleum Regulatory Authority (NMDPRA) is set to release four new regulations to guide the activities of the midstream and downstream sector of the oil and gas industry.

This was disclosed by Joseph Tolorunshe, Secretary and Legal Adviser, NMDPRA during the General Counsel and Legal Advisers’ Forum held on Wednesday in Abuja.

He noted that following the passage of the Petroleum Industry Act 2021, 12 Regulations have been gazetted and eight more will follow, which will give a total of 20 gazetted regulations.

Farouk Ahmed, Chief Executive, NMDPRA in his remarks also spoke on the perceived regulatory overlaps between the NMDPRA and the Nigerian Upstream Petroleum Regulatory Commission (NUPRC).

Ahmed who was represented by Ogbugo Ukoha, Executive Director, Distribution Systems, Storage & Retailing Infrastructure said stakeholders and potential investors require regulatory clarity to drive investment decisions and guide operations to ensure compliance with legal provisions and prevent reputational damage.

He added that the PIA was designed to restructure the industry by creating a boundary between the upstream, midstream and downstream value chain for growth and efficiency.

“The NUPRC is mandated to fully regulate all Upstream operations as defined in Section 318 in the PIA, conduct measurement of crude oil and natural gas produced for the purpose of royalty determination and ensure an arm’s length transfer to midstream operations at measurement points while the NMDPRA on the other hand is saddled with regulating the Midstream and downstream operations whether or not related to a lease,” he said.

Making reference to section 25 and 48 of the PIA, he said it is necessary to understand the two agencies are different from each other as they have diverse functions and roles to play in the industry.

“I am not oblivious of the major policy shift that the implementation of the PIA has necessitated which may have significantly impacted our business models, to fast track the implementation of the PIA, all stakeholders must adhere to the provisions of the law,” he said.
