Justice Mohammed Umar of the Federal High Court, Abuja, has scheduled May 8 to deliver a ruling on the no-case submission filed by activist Omoyele Sowore in his ongoing alleged cyberbullying case involving President Bola Ahmed Tinubu.
The case, instituted by the Department of State Services (DSS), is being prosecuted on behalf of the Federal Government. Sowore is accused of referring to the president as a “criminal” on his X (formerly Twitter) handle.
The court fixed the date after both the defence and prosecution adopted their final written arguments regarding the no-case submission.
While presenting his argument, Sowore’s counsel, Marshall Abubakar, told the court that the prosecution failed to establish any link between his client and the alleged offences.
He urged the court to uphold the no-case submission, insisting that Sowore was not connected to the two-count charge brought against him.
In response, counsel to the DSS, Akinlolu Kehinde, informed the court that the prosecution had filed its reply on April 23 and urged the court to dismiss the application.
The senior lawyer argued that the DSS had, through its witnesses, established a prima facie case and requested that the court compel the defendant to open his defence.
After hearing both sides, Justice Umar adjourned the matter to May 8 for a ruling on the no-case submission.
The DSS had earlier amended the cyberbullying charges filed against Sowore.
